1. Who you're dealing with
This website is operated by [[ENTITY — NOT DECIDED]] ("Kelm Shades," "we," "us"). By using kelmshades.com you agree to these terms. If you don't agree, please don't use the site.
These terms cover your use of this website. The work itself — your shades, your measurements, your installation — is governed by the written quote and order you sign with us. If the two ever conflict, the signed order wins.
2. This website is not an offer
Everything here is informational. The site doesn't list prices, doesn't take orders, and doesn't form a contract to sell you anything.
We describe products, materials, and options in general terms. What's actually available, what it costs, and what will work on your particular windows gets determined at the in-home visit and stated in a written quote.
Photographs and descriptions of fabric, color, and texture are approximations. Screens lie about color. That's why we bring physical samples to your home.
3. Booking a visit
When you request a visit through this site, you're asking us to contact you. You're not committing to buy anything, and we're not committing to a price.
Please give us accurate contact information and an accurate address. We drive to you.
The in-home visit is free. There is no obligation to purchase at the end of it.
4. Quotes
Quotes are given in writing after we measure. Each quote states how long it's good for, and it reflects the specific windows we measured, on the day we measured them.
If something changes — a different fabric, a different window, a different mounting condition we discover on install day — the price may change. We'll tell you before we do the work, not after.
5. Measurements
When we measure, we own the measurements. If a shade doesn't fit because we mis-measured, we remake it at our cost. That's the point of having us come out.
If you provide your own measurements and ask us to build to them, you're responsible for their accuracy, and a shade that doesn't fit because of a measurement you gave us isn't covered by that remake.
6. Custom orders and your right to cancel
Read this section. Custom window coverings are cut and assembled to the exact dimensions of your specific windows. Once built, they generally cannot be resold, returned to the manufacturer, or used on another home.
Your right to cancel. Because we sell through in-home visits, you have a right under federal and Utah law to cancel your order — for any reason, without penalty — until midnight of the third business day after the date you sign. Saturdays count as business days; Sundays and federal holidays do not. We will give you written notice of this right, and the forms to use, at the time you sign. If you cancel within that window, you get a full refund of everything you've paid, including any deposit.
After that window. Once the three-business-day cancellation period has passed and your order has gone into production, it is a custom, uniquely sized, special-order item, and we do not offer returns or refunds on it. This is not a fee we charge — it's that the product physically cannot go anywhere else.
We would rather lose the sale than have you feel rushed into it. If you're not certain on the day of the visit, take the three days. That's what they're for.
7. Deposits and payment
Deposit and payment terms are stated in your written quote and order.
Deposits are fully refundable during the three-business-day cancellation period described above.
8. Installation
Access. We need access to the windows. Please clear furniture, window treatments, and anything fragile from the work area before we arrive. If we can't safely reach a window, we may need to reschedule.
Existing conditions. We install into the wall, casing, or ceiling that's there. We're not responsible for the condition of your walls, framing, drywall, or existing hardware, or for defects we couldn't reasonably have seen — dry rot, prior damage, substandard framing, or something hidden behind the surface. If we find a condition that won't safely hold a mount, we'll stop and talk to you before continuing.
Small holes are how this works. Installing window coverings requires drilling. Removing them later leaves holes. That's normal and it isn't damage.
What we don't do. We don't move or reinstall your existing blinds unless the quote says so. We don't do electrical work — if a motorized shade needs hardwired power, that's a licensed electrician, and it's not included unless the quote says so.
9. Warranty
Product. Your shades carry the manufacturer's warranty. We'll give you the terms in writing with your order, and we'll handle the claim for you.
Our work. We warrant our installation. The term is stated in your written order. If a shade we installed comes loose, hangs wrong, or fails because of how we installed it, we come back and fix it. No charge.
What's not covered. Normal wear. Sun fading over time — every fabric fades eventually; that's what it's there for. Damage from misuse, accidents, pets, children, or someone else working on the shade. Damage from a condition in the home that we flagged and you asked us to install into anyway.
10. Limitation of liability
To the fullest extent allowed by law, [[ENTITY — NOT DECIDED]] is not liable for indirect, incidental, special, or consequential damages arising from this website or our services. Our total liability for any claim relating to an order is limited to the amount you paid for that order.
Nothing here limits liability for fraud, willful misconduct, personal injury caused by our negligence, or anything else the law says can't be limited. Some jurisdictions don't allow certain limitations, so parts of this may not apply to you.
11. Site content
The text, photographs, and design of this site belong to us. Don't copy them for a competing business.
If a photograph on this site shows a real installation, it's ours, and it was installed by us.
12. Links
We may link to other sites. We don't control them and we're not responsible for them.
13. Text messages
If you give us your number and opt in, we may text you. Reply STOP to stop. See the Privacy Policy for the details. Agreeing to texts is not a condition of buying anything.
14. Governing law
These terms are governed by the laws of the State of Utah. Any dispute will be brought in the state or federal courts located in Washington County, Utah, and you and we both agree to that venue.
15. Changes
We may update these terms. The date at the top tells you when we last did.
